HHS Announces:  Insurance Companies and Group Health Plans to Cover the Cost of At-Home COVID-19 Tests.  Effective January 15, 2022, over-the-counter COVID-19 diagnostic tests (authorized, cleared, or approved by the FDA) will be covered. Insurance companies and health plans are required to cover 8 free over-the-counter at-home tests per covered individual per month. A family of four, all on the same plan, would be able to get up to 32 of these tests covered by their health plan per month. There is no … Read More

CMS Omnibus COVID-19 Health Care Staff Vaccination Interim Final Rule – UPDATE

On December 15, 2021, in the continuing roller coaster of events surrounding the federal vaccine mandates, the U.S. Court of Appeals for the Fifth Circuit issued an Order removing the nationwide injunction against the CMS health care facility staff vaccine mandate but allowed the injunction to remain in place for the 14 challenging states (Louisiana, Montana, Arizona, Alabama, Georgia, Idaho, Indiana, Mississippi, Oklahoma, South Carolina, Utah, West Virginia, Kentucky and Ohio). Covid Testing For Employees Update

Effective Date The ETS is in effect as of publication in the Federal Register (11/5/21) and employers have 30 days— January 4, 2022– to comply with all requirements other than who have not completed their primary vaccination dose. Within 60 days, employers must be in compliance with testing requirements for employees who have not received all doses required for a primary vaccination. Just a quick recap of where things stand with the OSHA ETS on vaccination and testing. Almost immediately after the ETS was published on November 5, 2021, legal challenges were filed across the country in nearly every circuit of the US Court of Appeals.
